Defective decks: WA tradie fined after failing to fix dodgy work
Azad Satpathy, of Expert Decking and Tiling, has been ordered to pay $7,200 in fines and $1,000 costs after pleading guilty to two offences under Western Australia’s building complaints laws.
On 4 February, the Perth Magistrates Court heard the building commissioner issued two building remedy orders in 2023 requiring Satpathy to rectify defective decking work at properties in Treeby and Currambine.
The matters were investigated after the home owners lodged building service complaints with the Department of Local Government, Industry Regulation and Safety’s Building and Energy division.
Satpathy did not carry out the work required by the remedy orders, and they were later converted to payment orders.
Building commissioner Phil Payne warned tradespeople who did not uphold their responsibilities would be held to account.
“It is unacceptable to provide defective work in the first place as well as showing a blatant disregard for the opportunity to make it right,” Payne said.
“This case should remind industry that they are legally required to comply with a building remedy order and will face consequences if they disregard this.”
The matter followed a Perth landscaper being fined more than $16,000 after taking upfront deposits for jobs at three properties.
