Victorian surveyor hit with suspension and $25k fine after building failures
A City of Boroondara municipal building surveyor (MBS) is the first to be suspended after he failed to carry out his role competently and to a professional standard.
Asanka Kodikara will be prohibited from working as a surveyor when the Building and Plumbing Commission (BPC)’s ban comes into effect next month.
The regulator has also issued Kodikara with a $25,000 fine following the breaches, which were related to permits for a swimming pool at a site in Carnegie, and a front and rear home extension.
The BPC’s grounds for the penalty included that he acted incompetently and unprofessionally, failing to issue enforcement action and to obtain inspection certificates in a timely manner.
Additionally, it said Kodikara did not comply with the principles of the Building Surveyors Code of Conduct.
The BPC has also taken action against others involved, including disqualifying the builder on the permit, Aycon Constructions, for carrying out building work without the required insurance.
The regulator also successfully prosecuted unregistered builder, Upul Ranasinghe, who carried out the work on behalf of Aycon, and was convicted and fined $70,000 earlier this month.
Additionally, the BPC took disciplinary action against the building engineer, Mehran Orangi, who carried out inspections at the site.
Orangi was fined $15,000 and prohibited from conducting any inspections on behalf of building surveyors for six months.
In addition to his penalties, Kodikara must also complete a training course within 12 months.
BPC commissioner and CEO Anna Cronin said the regulator would crack down on any surveyors who acted unprofessionally.
“The BPC values the vital role of the building surveyor in the regulatory system but we won’t hesitate to act when they fail to do their job,” she concluded.
The matter followed a surge in dodgy building activity in recent years, with one unregistered Victorian builder fined $70,000 for carrying out illegal renovation work and failing to refund a single mother of three.
